1. General

1.1 These Terms and Conditions apply to all offers, orders, and agreements made through the website tracktoolfactory.com, between TrackTool Factory (“we”, “us”, “our”) and the consumer or business customer (“you”, “your”).

1.2 By placing an order, you agree to these Terms and Conditions.

1.3 These Terms comply with the Dutch Civil Code (Burgerlijk Wetboek), the EU Consumer Rights Directive (2011/83/EU), and other applicable EU and Dutch laws on distance selling.

1.4 TrackTool Factory reserves the right to modify these Terms at any time. The version applicable at the time of purchase will apply to your order.

2. Products and Information

2.1 We make every effort to display accurate product information, descriptions, and prices. However, minor variations in colour, design, or packaging may occur.

2.2 All specifications, technical data, and compatibility information are provided for guidance only. It is your responsibility to ensure that a product is suitable for your intended use before ordering.

2.3 TrackTool Factory shall not be liable for errors or omissions in product descriptions, provided such errors are not intentional or grossly negligent.

3. Prices and Payments

3.1 All prices on our website are listed in euros (€) and include Dutch VAT (BTW) unless otherwise stated.

3.2 Shipping costs are displayed separately during checkout.

3.3 We reserve the right to adjust prices at any time, but such changes will not affect confirmed orders.

3.4 Payment methods include credit/debit card, PayPal, and other secure payment gateways as indicated on our website. Orders will only be processed after full payment is received.

4. Order Acceptance

4.1 An order constitutes an offer to purchase goods from us. We reserve the right to accept or decline any order at our discretion.

4.2 If an order cannot be fulfilled (e.g. due to stock issues or pricing errors), we will inform you as soon as possible and issue a refund if payment was already made.

5. Shipping and Delivery

5.1 Each product page shows an estimated delivery window for the destination country. It is the time we need to dispatch the item plus the usual transit time to your address, counted in working days from our 11:00 CET order cut-off. The window shown when you place your order is the one that applies to that order.

5.2 Where a product page shows no delivery window, we will deliver without undue delay and in any event within 30 days of the contract being concluded, unless a longer period is agreed with you before you order.

5.3 The goods travel at our risk until they reach you. If a carrier is late, or a shipment goes missing, resolving it with the carrier is our responsibility and not yours. We are not responsible for delays caused by delivery information you gave us that was incorrect or incomplete, or by events outside our reasonable control (clause 11); such events do not affect your rights under 5.5.

5.4 Ownership of goods transfers to you upon full payment. Risk of loss or damage passes upon delivery.

5.5 If we miss the delivery window. If we have not delivered by the end of the delivery window that applied to your order — or, where no window was shown, within 30 days — you may give us a further period that is reasonable in the circumstances. If we have not delivered by the end of that further period, you may cancel the order, and we will refund everything you have paid for it, including the delivery charge, without undue delay.

5.6 You do not need to give us a further period, and may cancel immediately, if we have told you that we will not deliver, or if delivery within the agreed period was essential in the circumstances and you told us so before you ordered.

5.7 Nothing in these Terms restricts your rights under 5.5 and 5.6.

6. Right of Withdrawal (Consumer Orders)

6.1 Consumers within the EU have a 14-day withdrawal period from the day the goods are received, in accordance with the EU Consumer Rights Directive and Dutch law (Wet Koop op Afstand).

6.2 To exercise your right of withdrawal, use our online form, Withdraw from contract here, or contact us via info@tracktoolfactory.com within 14 days of receipt.

6.3 You then have another 14 days to return the goods.

6.4 You may inspect and handle the goods only to the extent necessary to establish their nature, characteristics and functioning, as you would reasonably be able to do in a physical shop. We ask that goods are returned complete and, where reasonably possible, in their original packaging. If you have handled the goods beyond what is necessary for that inspection, we may deduct the resulting reduction in value from your refund. You are responsible for the cost of returning the goods, unless the product is defective or was sent in error.

6.5 We will refund all payments received from you, including the standard delivery charge paid on the original order, within 14 days of the day we are informed of your decision to withdraw. Where you chose a delivery method more expensive than our cheapest standard option, we refund the standard amount. We may withhold the refund until we have received the goods back, or until you supply proof that you have sent them back, whichever is earlier. Refunds are made using the same payment method you used for the order, at no cost to you.

6.6 If you withdraw from part of an order only, the original delivery charge is not refunded.

6.7 The right of withdrawal does not apply to:

• goods made to your specification or clearly personalised;
• sealed goods which are not suitable for return for health protection or hygiene reasons, where they were unsealed after delivery.

7. Warranty and Liability

7.1 All products come with the legal guarantee (wettelijke garantie) required under Dutch and EU law — meaning that a product must meet what you may reasonably expect of it.

7.2 If a product does not conform to the contract, please contact us at info@tracktoolfactory.com with proof of purchase and, where possible, photographs. Please notify us within a reasonable period after you discover the problem; a notification made within two months of discovery is always considered timely.

7.3 Our liability is limited to repair, replacement, or refund of the defective product.

7.4 TrackTool Factory is not liable for:

• Improper or unsafe use of products

• Modifications or repairs not carried out by us

• Damage caused by incorrect installation or handling

• Any indirect, consequential, or incidental losses

7.5 Motorsport and mechanical tools are intended for off-road, training, or professional use only unless explicitly stated otherwise. Users are responsible for ensuring all equipment is used safely and legally.

7.6 Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Dutch or EU law.

8. Safety Disclaimer

8.1 Motorsport and workshop activities inherently involve risk. Products sold by TrackTool Factory should only be used by individuals with appropriate knowledge and safety awareness.

8.2 Always follow the manufacturer’s instructions and wear appropriate safety gear. TrackTool Factory cannot be held liable for injuries, damages, or losses resulting from misuse or unsafe operation of any product.

9. Intellectual Property

9.1 All content on tracktoolfactory.com, including text, images, logos, and product information, is protected by copyright and intellectual property laws.

9.2 You may not reproduce, modify, distribute, or reuse any content without our prior written consent.

10. Privacy and Data Protection

10.1 We process personal data in accordance with the General Data Protection Regulation (GDPR).

11. Force Majeure

We are not responsible for delays or non-performance resulting from events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, labour disputes, or transport disruptions.

12. Governing Law and Jurisdiction

12.1 These Terms and Conditions are governed by Dutch law.

12.2 In case of a dispute, we will seek an amicable resolution first.
If a resolution cannot be reached, disputes will be submitted to the competent court in Amsterdam, the Netherlands, unless otherwise required by mandatory consumer protection rules.

13. Reviews

13.1 Product reviews on our website can only be written by customers who bought that product from us. We check this against the e-mail address used for the order. Reviews may be checked by us before they are published.

13.2 The Google rating and the Google reviews shown on our website come directly from Google: the average rating and the number of reviews as Google reports them, and up to five reviews selected by Google. We do not edit them. Reviews on Google are checked by Google under its own policies, so we cannot confirm that every Google reviewer bought from us.
