1. General

1.1 These Terms and Conditions apply to all offers, orders, and agreements made through the website tracktoolfactory.com, between Track Tool Factory (“we”, “us”, “our”) and the consumer or business customer (“you”, “your”).

1.2 By placing an order, you agree to these Terms and Conditions.

1.3 These Terms comply with the Dutch Civil Code (Burgerlijk Wetboek), the EU Consumer Rights Directive (2011/83/EU), and other applicable EU and Dutch laws on distance selling.

1.4 Track Tool Factory reserves the right to modify these Terms at any time. The version applicable at the time of purchase will apply to your order.

2. Products and Information

2.1 We make every effort to display accurate product information, descriptions, and prices. However, minor variations in colour, design, or packaging may occur.

2.2 All specifications, technical data, and compatibility information are provided for guidance only. It is your responsibility to ensure that a product is suitable for your intended use before ordering.

2.3 Track Tool Factory shall not be liable for errors or omissions in product descriptions, provided such errors are not intentional or grossly negligent.

3. Prices and Payments

3.1 All prices on our website are listed in euros (€) and include Dutch VAT (BTW) unless otherwise stated.

3.2 Shipping costs are displayed separately during checkout.

3.3 We reserve the right to adjust prices at any time, but such changes will not affect confirmed orders.

3.4 Payment methods include credit/debit card, PayPal, and other secure payment gateways as indicated on our website. Orders will only be processed after full payment is received.

4. Order Acceptance

4.1 An order constitutes an offer to purchase goods from us. We reserve the right to accept or decline any order at our discretion.

4.2 If an order cannot be fulfilled (e.g. due to stock issues or pricing errors), we will inform you as soon as possible and issue a refund if payment was already made.

5. Shipping and Delivery

5.1 Shipping times are indicated on the product page. In-stock items are shipped within 1–7 business days, depending on order volume and warehouse location.

5.2 Delivery times within the EU typically range from 2–10 business days, depending on the destination and courier.

5.3 We are not liable for delays caused by third-party carriers, force majeure, or incorrect delivery information provided by you.

5.4 Ownership of goods transfers to you upon full payment. Risk of loss or damage passes upon delivery.

6. Right of Withdrawal (Consumer Orders)

6.1 Consumers within the EU have a 14-day withdrawal period from the day the goods are received, in accordance with the EU Consumer Rights Directive and Dutch law (Wet Koop op Afstand).

6.2 To exercise your right of withdrawal, contact us via info@tracktoolfactory.com within 14 days of receipt.

6.3 You then have another 14 days to return the goods.

6.4 Returned goods must be unused, undamaged, and in original packaging. You are responsible for the return shipping costs unless the product is defective or sent in error.

6.5 Refunds will be issued within 14 days after we receive and inspect the returned goods.

6.6 The right of withdrawal does not apply to:

• Custom-made or personalized products

• Products that cannot be returned for hygiene or safety reasons once unsealed or used

7. Warranty and Liability

7.1 All products come with the legal guarantee (wettelijke garantie) required under Dutch and EU law — meaning that a product must meet what you may reasonably expect of it.

7.2 If a product is defective, please contact us within 7 days of discovering the issue at info@tracktoolfactory.com with proof of purchase and photos.

7.3 Our liability is limited to repair, replacement, or refund of the defective product.

7.4 Track Tool Factory is not liable for:

• Improper or unsafe use of products

• Modifications or repairs not carried out by us

• Damage caused by incorrect installation or handling

• Any indirect, consequential, or incidental losses

7.5 Motorsport and mechanical tools are intended for off-road, training, or professional use only unless explicitly stated otherwise. Users are responsible for ensuring all equipment is used safely and legally.

7.6 Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Dutch or EU law.

8. Safety Disclaimer

8.1 Motorsport and workshop activities inherently involve risk. Products sold by Track Tool Factory should only be used by individuals with appropriate knowledge and safety awareness.

8.2 Always follow the manufacturer’s instructions and wear appropriate safety gear. Track Tool Factory cannot be held liable for injuries, damages, or losses resulting from misuse or unsafe operation of any product.

9. Intellectual Property

9.1 All content on tracktoolfactory.com, including text, images, logos, and product information, is protected by copyright and intellectual property laws.

9.2 You may not reproduce, modify, distribute, or reuse any content without our prior written consent.

10. Privacy and Data Protection

10.1 We process personal data in accordance with the General Data Protection Regulation (GDPR).

11. Force Majeure

We are not responsible for delays or non-performance resulting from events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, labour disputes, or transport disruptions.

12. Governing Law and Jurisdiction

12.1 These Terms and Conditions are governed by Dutch law.

12.2 In case of a dispute, we will seek an amicable resolution first.
If a resolution cannot be reached, disputes will be submitted to the competent court in Amsterdam, the Netherlands, unless otherwise required by mandatory consumer protection rules.
